2. Acceptance by the User
The present Legal Notice governs the use of the MOBIQUUS Service offered on www.mobiquus.com, and regulates both the website and the mobile phone application.
The use of the website and the mobile application shall be deemed to be the User's agreement to each and all of the conditions set forth below.
3. Correct use of the Service
The User agrees to use MOBIQUUS according to the law, the present license, generally accepted practices and public order. The User shall not use the web or the mobile application for unlawful aims or contrary to the aims established in this Legal Notice, which could be damaging to the rights or interests of third parties or which in any form could damage, disable or deteriorate the Service, thereby preventing normal use of and access to the Service on the part of other Users.
Also, the User expressly agrees not to destroy, alter, reverse engineer, decompile, disassemble or, in any way, harm the electronic data, programs or documents of which MOBIQUUS consists.
The User undertakes not to introduce programs, viruses, macros, applets, ActiveX controls or any other logical device or sequence of characters that cause or are liable to cause any kind of alteration to the computer systems pertaining to the website holder or third parties.
4. Intellectual property
All contents of the website and the mobile application are the property of Brane Labs SLL. In particular, the following list being merely for the purpose of example, and not exhaustive: graphic design, source code, logos, texts, illustrations and other materials contained in both the website and the mobile application.
Therefore, the User acknowledges that unauthorized copying, distribution, commercialization or transformation of the aforementioned materials constitute an infringement of Intellectual and Industrial Property Rights of Brane Labs SLL.
5. Disclaimer of liability
The User is solely responsible for the infringement of the Service or the damage he/she can cause due to the use of the MOBIQUUS Service. The User also agrees that Brane Labs SLL does not accept any liability for any form of damages which may arise from the User's actions.
The MOBIQUUS Service is provided 'as is', without warranty of any kind. Brane Labs SLL will not be liable for incidental damages including, but not limited to data loss; interruption of the Service; errors and safety breaches.
6. Personal information and Privacy Policy
By registering for the MOBIQUUS Service, the User is expressly giving Brane Labs SLL the right to automatic management of the data provided by the User for the use of the Service.
All information both provided by the User and collected through the use of the Service is strictly confidential. It shall solely and exclusively be used for the purposes of providing the MOBIQUUS Service. We shall not sell, rent or share the information with third parties unless required by law or authorized by the User.
As a part of the MOBIQUUS Service, contextual advertising might be sent to the User. We will always try to protect Users' privacy as much as possible.
When the MOBIQUUS Service is used, we do collect and store certain information about its use, such as the number of authentications, most frequently used options, time of use, log files (including IP, browser type, date and time). All this information will be used by MOBIQUUS to improve our Service.
By registering for MOBIQUUS, the User is giving us permission to send him/her information concerning new functions or Service incidents, as well as notifications about new products developed by Brane Labs SLL.
7. Ending your relationship with MOBIQUUS
You may terminate the use of the Service at any time. MOBIQUUS grants you the option to close your account.
MOBIQUUS may terminate at any time its relationship with the User if he/she breaches any terms of the present User license or misuses the MOBIQUUS Service. Other reasons that Brane Labs SLL might have to end the Service are: User account inactivity for more than 90 days, the discontinuation of service provision by MOBIQUUS to the User's country and failure on the part of the company to provide a commercially viable Service.
